IMPORTANT: By accessing or using Vibez AI, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree, please discontinue use immediately.

1. About Vibez AI

Vibez AI is a fully automated, digital-only SaaS platform for AI-powered photo editing and image generation. All features are delivered entirely through software — no human labour, manual delivery, or physical goods are involved in any transaction.

Core platform features:

• AI image generation from text prompts
• AI photo editing and transformation
• 50+ pre-built AI style presets (headshots, anime, cyberpunk, vintage, and more)
• AI sticker creation
• Image library management with folders and gallery

2. Eligibility & Account Requirements

2.1 Age Requirements

You must be at least 13 years of age to use Vibez AI. Users aged 13–17 must have express parental or guardian consent. Parents and guardians are fully responsible for supervising and consenting on behalf of any minor user.

2.2 Legal Capacity

By registering, you confirm that you have the legal capacity to enter into a binding agreement, that you will comply with all applicable laws in your jurisdiction, and that your use will not violate any third-party rights.

2.3 Account Creation & Security

Accounts may be created via email/password or Google OAuth. You must provide accurate registration details, maintain only one account per person, and keep your credentials confidential. You must notify us immediately at support@vibezai.app of any unauthorized account access. You are responsible for all activity conducted under your account.

3. Digital Product & Credit System

Vibez AI operates a credit-based system to access AI generation features. Credits are consumed for the following automated, software-delivered actions:

• AI image generation from text prompts
• AI photo editing and transformation
• AI sticker creation

All outputs are delivered instantly and automatically within the platform. No human involvement or physical delivery is required at any stage.

3.1 Credit Pricing

• Standard quality (Vibez AI model): 10 credits per image
• High quality (Nano Banana 2): 20 credits per image
• Ultra HD (Nano Banana Pro): 40 credits per image

3.2 Free Tier

New users receive 6 complimentary credits upon registration. No payment information is required for the free tier. Free credits do not expire.

4. Subscriptions & Payments

4.1 Subscription Plans

• Starter — USD $9/month (500 credits)
• Pro — USD $29/month (2,000 credits)
• Studio — USD $49/month (4,000 credits)

Annual billing is available at a discounted rate. Unused subscription credits do not roll over to the following billing period.

4.2 One-Time Credit Packs

Users may purchase one-time credit packs starting at USD $5 for 200 credits. Credits are added to the account automatically and immediately upon confirmed payment. One-time credit pack credits never expire and are non-refundable except in the case of a verified technical delivery failure (see Section 5.2).

4.3 Payment Processing

All payments are processed securely through DodoPayments, which acts as the Merchant of Record for all transactions on this platform. By completing a purchase, you also agree to DodoPayments' Buyer Terms and Conditions, available at dodopayments.com. Vibez AI accepts major credit and debit cards as well as all payment methods supported by DodoPayments.

4.4 Subscription Cancellation

You may cancel your subscription at any time by emailing support@vibezai.app. Cancellation takes effect at the end of the then-current billing period. No refunds are issued for partial billing periods. Any unused subscription credits are forfeited upon cancellation.

5. Refund Policy

5.1 Subscription Refunds

A full refund is available on the initial subscription purchase if: (a) the cancellation request is submitted within 7 calendar days of the initial charge, and (b) fewer than 50 credits have been consumed. After these conditions are no longer met, no refunds are available; the subscription remains active until the end of the billing period.

5.2 One-Time Credit Pack Refunds

One-time credit pack purchases are final and non-refundable. If you experience a verified technical failure resulting in non-delivery of purchased credits, please contact support@vibezai.app within 48 hours of the transaction with your account email and order reference. We will investigate and, where a technical fault is confirmed, will restore the appropriate credits or issue a refund at our discretion.

5.3 Refund Process

To request a refund, email support@vibezai.app with your account email address and payment order details. Eligible refunds are processed within 5–10 business days.

6. User Content & Intellectual Property

6.1 Uploaded Content

You retain full ownership of all content you upload to Vibez AI. By uploading, you grant Vibez AI a limited, non-exclusive, royalty-free licence to process your content solely for the purpose of delivering the Services to you. This licence terminates when you delete the content or your account.

6.2 AI-Generated Content

• Free & Starter plans: Personal, non-commercial use only
• Pro & Studio plans: Full commercial licence included

Vibez AI does not claim ownership of your AI-generated images. We do not use your uploaded photos or generated images to train AI models, and we do not share your images with third parties.

6.3 Prohibited Content

You may not use the platform to generate, upload, or process any of the following:

• Child sexual abuse material (CSAM) or any sexualised content involving minors
• Non-consensual intimate imagery of any real person
• Deepfakes or impersonations of real individuals for fraudulent or deceptive purposes
• Content that is threatening, hateful, or incites violence
• Content that infringes any third-party copyright, trademark, or other intellectual property rights
• Content that is illegal in the user's or target audience's jurisdiction

We enforce a strict zero-tolerance policy on CSAM and non-consensual intimate imagery. Violations will result in immediate account termination and reporting to the relevant authorities.

7. Acceptable Use Policy

When using Vibez AI, you agree not to:

1. Reverse-engineer, decompile, or extract the platform's source code or proprietary algorithms
2. Use automated bots, scripts, or scraping tools to access or interact with the platform
3. Circumvent credit limits, usage controls, or security mechanisms
4. Share account credentials with any third party
5. Resell, redistribute, or sublicence access to the Services
6. Create multiple accounts to abuse free credit allocations
7. Impersonate any person or entity
8. Use the platform in any manner that violates applicable law

8. AI-Generated Content Disclaimer

Vibez AI uses artificial intelligence to generate and transform images. AI outputs may be unexpected, imperfect, or not fully aligned with your prompt. We do not guarantee the accuracy, quality, or fitness for purpose of any AI-generated output. You are solely responsible for reviewing all generated content before use or publication.

9. Intellectual Property — Platform

All rights in the Vibez AI platform, including its code, design, trademarks, branding, and proprietary AI models, are owned by or licensed to Vibez AI. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services solely in accordance with these Terms.

10. Data Protection & Privacy

Your use of Vibez AI is subject to our Privacy Policy, available at vibezai.app/privacy-policy. We collect and process personal data in accordance with applicable data protection laws, including GDPR where applicable. We do not sell your personal data to third parties.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBEZ AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO VIBEZ AI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

13. Term & Termination

These Terms remain in effect for as long as you use the Services. You may delete your account at any time by emailing support@vibezai.app. Your personal data will be removed within 30 days of account deletion, subject to any legal retention obligations.

Vibez AI may suspend or terminate your account immediately, without notice or refund, if you breach these Terms, engage in fraudulent activity, or if required by law or our payment partners. Upon termination, your right to access the Services ceases immediately.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will update the Effective Date at the top of this document. For material changes, we will provide notice via email or an in-app notification where reasonably practicable. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

15. Dispute Resolution

If you have a dispute with us, please contact support@vibezai.app first. We will attempt to resolve the matter in good faith within 30 days. If unresolved, disputes shall be subject to binding arbitration in accordance with applicable law. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

16. Governing Law

These Terms are governed by and construed in accordance with applicable law. If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
